User-Generated Content and Platform Liability
Business Mondays is an open publishing platform that facilitates the sharing of many user-generated content, including press releases, articles, and multimedia assets, such as photographs and graphics. We act solely as an intermediary for many of our news stories and do not create, fact-verify, or endorse the content submitted by users.
Business Mondays operates primarily as an automated content publishing system that enables users to upload and publish content. While we may conduct minimal, non-editorial cursory checks of submissions (such as for spam, obviously illegal content, or technical formatting issues), we do not exercise substantive editorial control or make content decisions about the accuracy, quality, or legality of user submissions prior to publication. This limited oversight does not alter our fundamental role as an information society service provider that stores information provided by recipients of the service, as defined under Regulation 19 of the Electronic Commerce (EC Directive) Regulations 2002.
Due to the automated nature of our platform, Business Mondays has no actual knowledge of potential unlawful activity or information in user submissions prior to publication. We rely on our users’ adherence to these Terms and Conditions and their confirmation that they have all necessary rights to share the content they submit.
By submitting content to Business Mondays, you acknowledge and agree that:
- You are solely responsible for the legality, accuracy, originality, and ownership of all content you upload or submit, including (but not limited to) text, images, graphics, videos, and any third-party materials.
- You confirm that you have obtained all necessary rights, licences, and permissions to publish such content on Business Mondays, and to grant us a non-exclusive right to display and distribute that content.
- You agree to indemnify and hold harmless Business Mondays, its owners, operators, and affiliates, against any claims, costs, damages, or liabilities arising from any breach of copyright, intellectual property rights, or other laws resulting from the content you submit.
Business Mondays does not assume responsibility for user-submitted content and expressly disclaims any and all liability arising from such content, whether due to errors, omissions, copyright infringement, defamation, or otherwise. - During the submission process, all users must actively confirm by checking a mandatory box that confirms they have permission from the content / image owner to share on this platform.
While Business Mondays may occasionally make minor formatting adjustments for display purposes, we do not substantially modify or exercise editorial control over the substance of user-submitted content prior to publication. This technical and operational approach reinforces our status as a hosting provider rather than a content publisher under Regulation 19 of the Electronic Commerce (EC Directive) Regulations 2002.
We operate in accordance with relevant laws, including:
- Regulation 19 of the Electronic Commerce (EC Directive) Regulations 2002
- Tamiz v Google Inc. [2013] EWCA Civ 68 (UK case law)
- Article 14 of the E-Commerce Directive 2000/31/EC (EU law)
- Section 230 of the Communications Decency Act (US law)
In line with these legal frameworks, Business Mondays, as a passive news hosting service, is not liable for content stored at the direction of users, provided we are not aware of unlawful content. As required by Regulation 19 of the Electronic Commerce (EC Directive) Regulations 2002, upon obtaining actual knowledge or awareness of unlawful activity or information, we act expeditiously to remove or disable access to the information. Upon notification of potential legal infringements, we act expeditiously to review and, where appropriate, remove the content in question, as outlined in our Copyright Takedown Policy.
This model is consistent with the operational and legal frameworks adopted by social platforms such as Facebook, LinkedIn, and X (formerly Twitter).
If you believe any content hosted on Business Mondays infringes your rights, please follow the procedure outlined in our Takedown Policy.

Some of our services are paid-for digital services, which require payment at the point of submission via our online payment system.
By submitting content and using a paid service, you agree to the applicable service fee for that submission. In the event that payment is not successfully collected due to a payment gateway error, timeout, failed transaction, or similar issue, you remain liable for the full cost of the service provided.
Where payment has not been completed at the point of submission, we reserve the right to issue an invoice for the outstanding amount. Any invoiced amounts must be paid in full in accordance with the payment terms stated on the invoice.
Submission of content and publication of material is conditional on acceptance of these payment terms.

Refund & cancellation policy
If you believe a digital service is not as described or not of satisfactory quality, please contact us at [email protected], and we will review your request and, where appropriate, arrange a refund.
For individual news publication services, all submissions are subject to our editorial guidelines. If a submission does not meet these guidelines and is not published, we will aim to provide feedback explaining our decision. In such cases, a full refund of the individual payment will be issued.
For monthly subscription plans, you may cancel at any time by emailing [email protected]. We require a minimum of 30 days’ notice to process cancellations. This allows us to cancel any scheduled content or services linked to your plan.
If you submit content under a subscription plan that does not meet our editorial guidelines, no full or partial refund of the subscription fee will be provided.
Partial refunds are not available for subscription services once payment has been taken.
